Terms of Service

These Terms govern your access to and use of abbiey.search. By using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

abbiey.search ("we", "our", "the service") is a privacy-respecting web search engine operated by Abbiey Matthews. It proxies results from third-party sources (DuckDuckGo, Ahmia, and others) and presents them to you without tracking your queries.

2. Eligibility

You must be at least 13 years old to use abbiey.search. By using the service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

You are responsible for maintaining the confidentiality of your password.
You are responsible for all activity that occurs under your account.
Notify us immediately at support@abbieysearch.com if you suspect unauthorised access.
You may not create an account on behalf of someone else without their consent.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use abbiey.search to:

Violate any applicable law or regulation.
Infringe the intellectual property or privacy rights of others.
Harass, threaten, or harm any person.
Distribute malware, phishing content, or other harmful code.
Attempt to gain unauthorised access to our systems or those of third parties.
Scrape, crawl, or programmatically access the service in a way that degrades performance for other users, without our written permission.
Circumvent rate limits, access controls, or other technical measures.
Impersonate another person or entity.

5. Search Results

abbiey.search retrieves and displays results from third-party sources. We do not own, control, endorse, or guarantee the accuracy, legality, or appropriateness of any third-party content returned in search results. You are solely responsible for evaluating the content you access via search results.

Optional public signals (OSINT). If you use in-product OSINT tools, you agree to use them only for lawful purposes (such as security research or network troubleshooting with authorisation). You must not use them to harass, stalk, or violate anyone’s privacy, or to violate third-party terms. OSINT output is derived from public registries and DNS and may be wrong or incomplete; see the Privacy Policy for data flows.

6. Paid Features

Certain features (unlimited search, API keys) are available via a one-time or recurring payment processed by Stripe. By making a purchase:

You authorise us to charge your payment method for the stated amount.
All prices are in USD unless stated otherwise.
Refunds are available within 7 days of purchase if the feature did not work as described. Email support@abbieysearch.com.
We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Intellectual Property

The abbiey.search name, logo, and original software code are owned by or licensed to us. Nothing in these Terms transfers ownership of our intellectual property to you. You may not use our name or logo without prior written consent.

Search results, snippets, and third-party content are owned by their respective rights holders. We make no claim of ownership over such content.

8. Privacy

Your use of abbiey.search is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

Your use of or inability to use the service.
Any content obtained through the service.
Unauthorised access to or alteration of your data.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months prior to the claim, or USD $10, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless abbiey.search and its operators from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the service or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. You may stop using the service or delete your account at any time. Sections 7, 9, 10, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in Australia, and you consent to such jurisdiction.

14. Changes to These Terms

We may update these Terms. Material changes will be communicated via email or a notice on the website at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
